Who We Are
Memorable Stories, Inc. ("Memorable," "we," "us," or "our") provides a platform that helps users capture, organize, edit, preserve, share and transform personal memories, stories, audio, transcripts, and related content into digital experiences and, where offered, physical products such as printed books (the "Services").
Acceptance of Terms
By creating an account, accessing, or using the Services, you agree to these Terms of Service ("Terms"). If you do not agree, do not use the Services.
If you use the Services on behalf of another person or organization, you represent that you are authorized to accept these Terms on their behalf.
Eligibility
You must be at least 18 years old to use the Services, or the age of legal majority where you live. The Services are not directed to children under 13.
Your Account
You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You agree to provide accurate information and keep it updated.
You must notify us promptly if you believe your account has been accessed without authorization.
The Services
Memorable allows users to:
record or upload memories, stories, voice recordings, transcripts, and related materials;
edit and organize content;
generate AI-assisted prompts, summaries, drafts, or book-ready content;
order physical or digital outputs, where available.
We may modify, improve, suspend, or discontinue any part of the Services at any time.
AI-Assisted Features
Some parts of the Services may use artificial intelligence to generate interview prompts, summaries, edits, titles, structure, suggested language, or other outputs.
AI-generated outputs may be incomplete, inaccurate, biased, or may not reflect your intended meaning. You are responsible for reviewing, editing, and approving any AI-generated or AI-assisted output before relying on it, sharing it, or sending it to print. The final content of any biography, book, or other output remains your responsibility.
Your Content
"User Content" means the text, audio, images, video, documents, metadata, and other content you submit, record, upload, generate, edit, or share through the Services.
You retain ownership of your User Content, subject to the rights you grant us below.
Service Scope and Completion Window
Your purchase includes up to 20 hours of recorded interview time and a 6-month period to complete your biography, unless otherwise stated at the time of purchase. Unused recorded time expires at the end of that 6-month period and does not roll over, renew, or convert into cash, credit, or refund, unless otherwise required by law or expressly stated by Memorable.
License You Grant to Memorable
You grant Memorable a non-exclusive, worldwide, royalty-free license to host, store, reproduce, process, format, modify, display, perform, transmit, and use your User Content solely as reasonably necessary to:
provide and operate the Services;
generate requested outputs;
maintain backups;
improve functionality, safety, and service quality; and
fulfill printing, production, shipping, customer support, and related operational purposes.
We do not use the actual stories, recordings, transcripts, or other expressive content you create in Memorable to improve our product, models, or services, except as needed to provide the Services you request. We may, however, use aggregated and de-identified information about how the Services are used—such as feature usage, navigation patterns, completion rates, and technical performance metrics—to improve functionality, reliability, safety, and the overall user experience, as described in our Privacy Policy.
Permissions and Consents for Third-Party Content
You represent and warrant that you have all rights, permissions, and consents necessary for the User Content you submit, including for any content that relates to another person, such as their voice, image, story, correspondence, or personal information.
If you submit content about another person, you are responsible for ensuring you have the right to do so. If your User Content includes information about a minor, you represent that you are the parent or legal guardian of that minor, or otherwise have the legal authority to provide that information.
Sensitive, Personal, and Family Content
The Services may involve personal, emotional, family, historical, or memorial content. You understand that such content may be sensitive.
You should avoid uploading content that you do not want processed, stored, or shared through a digital service. Do not upload highly sensitive information such as social security numbers, financial account credentials, medical records, or other information not necessary for the intended use of the Services.
Physical Products and Printing
If you order printed books or other physical products:
you are responsible for final review and approval of all content before production, including any AI-assisted summaries, edits, layouts, titles, and other generated material;
once content is approved for print, changes may not be possible;
colors, cropping, layout, paper, and print quality may vary slightly from on-screen previews;
shipping and delivery dates are estimates, not guarantees; and
third-party print and logistics partners may be involved.
Risk of loss and title for physical goods transfer to you upon delivery to the shipping carrier, unless otherwise required by law.
Fees and Payments
Certain features may require payment. You agree to pay all applicable fees, taxes, shipping charges, and other amounts shown at checkout.
For one-time purchases, payment is charged upfront at the time of purchase. Unless otherwise required by law, one-time purchase fees are non-refundable.
If Memorable Stories, Inc. introduces subscription-based features in the future, such as memory storage or related services, those subscriptions will renew automatically unless canceled before the next billing date, where permitted by law and as described at the time of purchase. You may stop subscription billing at any time by canceling before the next renewal date.
We may change pricing prospectively. Price changes will not affect a current billing period already paid for.
Refunds
Except where required by law, fees are non-refundable. If a printed book or other physical product arrives damaged or defective, contact us at support@memorablestories.ai within [14] days of delivery. In such cases, Memorable Stories, Inc. may, at its discretion, replace the damaged or defective item at its own expense rather than provide a refund.
Acceptable Use
You agree not to:
use the Services unlawfully or in violation of another person’s rights;
upload content that is defamatory, fraudulent, infringing, harassing, hateful, or abusive;
impersonate another person or misrepresent your authority;
interfere with or disrupt the Services;
attempt to access data, systems, or accounts without authorization;
scrape, reverse engineer, or use the Services to build a competing product except where such restriction is prohibited by law; or
use the Services to store or transmit malware or malicious code.
Intellectual Property
The Services, including our software, designs, branding, text, graphics, interfaces, and technology, are owned by Memorable or our licensors and are protected by intellectual property laws.
Except for the limited right to use the Services under these Terms, no rights are granted to you.
Feedback
If you provide suggestions, ideas, or feedback, we may use them without restriction or compensation to you.
Privacy
Your use of the Services is also governed by our Privacy Policy.
Deletion of Content and Account
You may request deletion of your account by contacting us at support@memorablestories.ai. If you request deletion before a print order has entered production, we will stop processing the content for that order where reasonably possible.
If a print order has already entered production or been fulfilled, deletion will not affect physical copies already produced or information we must retain for legal, tax, security, fraud-prevention, backup, or operational purposes. Additional details about deletion and retention are described in our Privacy Policy.
Termination
You may stop using the Services at any time. We may suspend or terminate your access if you violate these Terms, create risk or harm, or if we discontinue the Services.
Upon termination, provisions that by their nature should survive will survive, including ownership, licenses, disclaimers, limitations of liability, indemnity, and dispute provisions.
Disclaimers
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, MEMORABLE DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND THAT THE SERVICES WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, MEMORABLE AND ITS AFFILIATES, OFFICERS, EMPLOYEES, CONTRACTORS, AND PARTNERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, DATA, GOODWILL, OR BUSINESS INTERRUPTION.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, MEMORABLE’S TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICES WILL NOT EXCEED THE GREATER OF: (A) THE AMOUNTS YOU PAID TO MEMORABLE IN THE 12 MONTHS BEFORE THE CLAIM AROSE; OR (B) USD $100.
Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
Indemnification
You agree to indemnify and hold harmless Memorable Stories, Inc. and its affiliates, officers, employees, contractors, and partners from and against third-party claims, liabilities, damages, losses, and expenses, including reasonable attorneys’ fees, arising out of or related to: (a) your User Content; (b) your violation of these Terms; (c) your violation of applicable law; or (d) your infringement or violation of another person’s rights.
Dispute Resolution
These Terms are governed by the laws of the State of Delaware, without regard to conflict of laws principles.
Any dispute arising out of or relating to these Terms or the Services will be resolved in the state or federal courts located in Delaware, and you consent to their jurisdiction and venue, unless applicable law requires otherwise.
Nothing in these Terms limits any consumer rights you may have under mandatory law in your country of residence.
Optional arbitration clause may be added after legal review.
Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will provide notice by posting the updated Terms, updating the effective date, and, where appropriate, notifying you through the Services or by email.
Your continued use of the Services after the updated Terms become effective means you accept them.
